D.C. Court of Appeals deals a setback to Barry Farm redevelopment

The D.C. Court of Appeals on Thursday vacated an order issued by the District’s Zoning Commission that approved the redevelopment of Barry Farm, a key public housing complex near the Anacostia Metro station.

The decision hands a victory to citizens who oppose the project and throws a roadblock into plans by the city to transform the Southeast D.C. enclave into a mixed-income community with rentals and townhomes.

In an opinion issued Thursday, Chief Judge Anna Blackburne-Rigsby vacated the D.C. Zoning Commission 2014 order that approved a first-stage Planned Unit Development for the Barry Farm project and remanded the case back to the commission for further proceedings.

“We conclude that the Commission did not fully address all contested issues as required by the zoning and redevelopment regulatory scheme,” the order read. “We vacate the Commission’s order and remand this case for further proceedings as discussed in this decision.”
